AB  - Рад анализира институционалне механизме партиципације младих, као посебне друштвене категорије, у креирању и спровођењу политика, са акцентом на локални ниво. Кроз рад је приказан значај социјалног капитала младих за развој здраве и одрживе заједнице. Методом анализе садржаја правних норми, пре свега Закона о младима и Националним стратегијама за младе, приказани су институционални проблеми организовања младих, и понуђена су конкретна нормативна решења која могу да постану део новог закона о младима. Посебан акценат је стављен на институционални оквир организовања младих на локалном нивоу, анализиране су канцеларије за младе, простори за младе и омладински рад. Резултати анализе су показали да постоје бројни проблеми којиизвиру из недоречености закона по овим питањима. Такође, компаративном методом у раду су представљена решења истих питањау неким државама чланицама Европске уније и Западног Балкана.
AB  - The paper analyzes the institutional mechanisms of youth participation in the creation and
implementation of public policies, with a focus on the local level. The paper highlights the
importance of young people’s social capital for the development of a healthy and sustainable
community. Through active participation, formal and informal association, and continuous
communication with local institutions, young people develop opportunities to express and fulfill
their rights and needs, while contributing to the overall development of the local community.
The Law on Youth, which was adopted in the Republic of Serbia over 10 years ago, determines
the ways of organizing youth, but there have been numerous problems in its implementation.
Using the metod of content analysis of legal norms, primarily the Law on Youth and National
Youth Strategies, institutional problems of youth organization are presented, and specific
normative solutions that could become part of a new youth law are proposed. Special emphasis is
placed on the institutional framework of youth organization at the local level, where youth
offices, youth spaces and youth work are analyzed. The results of the analysis have shown
numerous problems resulting from unclear and insufficiently developed provisions of the law on these issues. Additionally, the paper presents comparative solutions for the same issues in certain European Union member states and Western Balkans countries.

AB  - Predmet ovog rada je položaj i status institucije lokalnog ombudsmana u Republici Bugarskoj prikazan na primerima opštine Stara Zagora i grada Sofije. Bugarska i Srbija spadaju u krug zemalja koje imaju instituciju ombudsmana na centralnom i lokalnom nivou. U obe zemlje, institucija lokalnog ombudsmana je nastala i razvijala se u relativno sličnim okolnostima, vremenskom periodu i uslovima, a relativno mali broj JLS se do danas odlučio za njeno osnivanje. Međutim, to ne znači da je lokalni ombudsman još jedna u nizu nepotrebnih i „promašenih” institucija koje se mogu pojaviti u političko-pravnim sistemima pojedinih država. Ovo istraživanje treba da pokaže, s jedne strane, svrhu institucije lokalnog ombudsmana, a sa druge, značaj koji ova institucija ima u opštinama i gradovima u Bugarskoj, analizom njihovih sličnosti i razlika u Sofiji i Staroj Zagori. Dodatno, u Srbiji niko se do sada nije naučno bavio proučavanjem ove institucije u Bugarskoj. U Bugarskoj, s druge strane, nema značajnijih istraživanja koja bi se odnosila na ovu instituciju. U Srbiji je naučni i stručni fond koji se odnosi na instituciju lokalnog ombudsmana takođe mali. Ovaj rad treba da posluži i upoznavanju naučne i stručne javnosti sa ovom institucijom, ali i da doprinese dodatnom komparativnom, tzv. „tvining” istraživanju, koje bi moglo da omogući bolje sagledavanje i dalji razvoj ove institucije u obe zemlje u budućnosti.
AB  - The subject of this paper is the position and status of the institution of
local ombudsman in the Republic of Bulgaria shown on the examples of these institu-
tions in the municipalities of Stara Zagora and Sofia. The Republic of Bulgaria and the
Republic of Serbia belong to the circle of countries, which in their political and legal
systems have the institution of ombudsman at the central level, but they can also have it
at the level of local self-governments. In both countries, this institution was created and
developed in relatively similar circumstances and time period as well as under similar
conditions. In both countries, given the optional character of the institution, a relatively
small number of municipalities and cities, have decided to establish local ombudsman.
However, this does not mean that the local ombudsman is another in a series of un-
necessary and “failed” institutions that may appear in the political and legal systems of
individual states. This research should show, on the one hand, the purpose of the local
ombudsman institution, and on the other hand, the importance that this institution has
in the municipalities and cities in Bulgaria, by analysing their similarities and differ-
ences in Sofia and Stara Zagora. In addition, no one in the Republic of Serbia has so far
scientifically studied this institution in Bulgaria. In Bulgaria, on the other hand, there is
no significant research related to this institution. In the Republic of Serbia, the scientific
and professional fund related to the institution of the local ombudsman in our country
is also rare. This paper should contribute to a “twinning” research that could lead to a
better understanding and further development of this institution in Serbia and Bulgaria.

Value for money in public.private partnership projects in the field of street lighting in the Republic of Serbia

AB  - Public administration reform, better known as the New Public Management NPM, which began in the mid-1970s, had a key impact on the development of modern public administration. The NPM emphasizes the economic values of public administration, to the detriment of its other values. Public Private Partnership- PPP is one of the basic elements of NPM doctrine. PPP is a partnership between the public and private sector that aims to provide a service traditionally provided by the public sector. An integral part of every PPP is the Value for Money methodology. The "Value for money"- VfM method emerged in this process of public administration reform, first in the UK. The document of the British Government Private Finance Initiative (PFI) from the year 1992, presented the basis for the creation of a new so-called "Venture", which at that time was called a joint venture, and which is today known as PPP. PPP is a relatively new institute that has existed in the Republic of Serbia since 2011. In this paper, we will deal with the application of the VfM methodology in PPP projects related to street lighting in the Republic of Serbia, and try to give answer about social and economic justification of PPP and potential economic savings that can be achieved in the public sector through the implementation of PPP. At the present time, when there is more and more talk about the need for environmental protection, sustainable development and energy efficiency, PPP projects can have an increasing importance in this area. For this reason, we have limited the application of VfM methods in PPP projects in the Republic of Serbia only to street lighting projects which provide the mentioned goals.

The Effectiveness of Self-Employment of the Roma - A Quasi Experimental Design

AB  - This paper is based on the estimation of the effects of the self-employment of the Roma on their social values and work attitudes. To provide the evidence for the possible positive outcomes of starting their own business, we used a quasi experimental design, i.e. we provided the design based on a comparison of the self-employed Roma (experimental group) and those who did not start their business (control group). We tested the operational hypothesis onto eight measurements of the values and work attitudes. As a method, OLS regression and logistic regression have been employed. We found that self-employment policy of Roma can significantly contribute to their positive work attitude, internal locus of control, interpersonal trust, perceived treatment by the majority and job satisfaction. However, we found no significant effect of starting new business by the Roma onto intrinsic work orientation, gender equality attitude and overall life satisfaction. We conclude that promoting and investing in self-employment policy of the Roma and marginalized groups in general can be an effective policy measure in improving their overall social inclusion.

We conclude that promoting and investing in self-employment policy of the Roma and marginalized groups in general can be an effective policy measure in improving their overall social inclusion.",

In it, the local government has on important role, which derives grom the legal framework governing urban development. However, today’s local authorities should listen to the citizens needs. Particularly in this area, relation and communication between local authorities and citizens, as well as other stakeholders, is crucial. In this paper, special attention will be focused on determining the concept of micro public spaces. Also, examples of good practice some of city authorities in planning and micro public sapces development strategies will be covred. Finally, we will point out the role of citizens and other stakeholders in urban planning micro public spaces.

AB  - Kroz zajednička partnerstva u oblasti turizma, država, lokalne vlasti i privatni partneri mogu ostvariti i unaprediti razvoj turističkih potencijala na održiv način. Koncesija predstavlja važno sredstvo za unapređenje kvaliteta turističkih usluga, kaoi za istraživanje, marketing i promocije. U mnogim zemljama, turističke usluge se upravo pružaju kroz koncesije ili sporazume između različitih aktera i institucija posebno u oblasti banjskog turizma, termo-mineralnih izvora, i drugih turističkih lokaliteta od nacionalnog značaja. Iako privatizacija i tržišno zasnovana rešenja mogu imati benefite za zaštićena područja, ona nisu uvek najbolji odgovor, i bez odgovarajućeg upravljanja mogu da donesu izvesne rizike za prirodne resurse od kojih turizam zavisi.

AB  - Predmet ovog rada je značaj sekundardnih izvora prava EU na unapređenje pravne regulative
Republike Srbije po pitanju obnovljivih izvora energije. Pod pojmom obnovljivi izvori energije se
najčešće podrazumevaju hidroenergija, vetroenergija, geotermalna energija, solarna energija i bio
energija. U ovom radu fokusiramo se na na tri vida obnovljivih izvora energije i njihove potencijale
u Republici Srbiji tačnije, vetroenergiju, geotermalnu energiju i solarnu energija, kao i na pravne
standarde koji se odnose na njihovo korišćenje u EU i Republici Srbiji. Danas postoje brojni
problemi sa zahtevima i uslovima EU koji se odnose na usvajanje i implementaciju standarda o
oblasti obnovljivih izvora, posebno onih koji su sadržani u EU Direktivi 2009/28/EC. Vlada
Republike Srbije se obavezala da će povećati udeo obnovljivih izvora energije sa 21,2% na 27% već 2020 godine, ali uprkos proklamovanim ciljevima i usvojenom zakonodavnom okviru, Srbija još
zaostaje za njihovom implementacijom.

Administrative-procedural and other similar forms of protection of the right of access to information in comparative law

AB  - Pursuit for new and more effective forms of control of public admini­stration and public authorities in general, has led to the emergence of a new citizens' right in the mid 60's of the 20th century, which some authors might rightly call fundamental - the right of free access to information (FAI). In the past fifty years this right quickly spread to all continents and today more than 100 countries are closely regulating the manner of its implementation and protection through specific laws. This paper presents a comparative analysis of the administrative-procedural and other similar forms of protection of the right of access to information in 19 countries. The study reveals that in the comparative legislation, many different models of its protection can be recognized. A number of countries persist on the traditional model of administrative-procedural protection of this right. However, in affirmation of this right, citizens are becoming the 'fourth power' which directly controls the work of state bodies and with time this led to the establishment of new models different from this traditional one. Notably it is a model which involves independent and autonomous control authority with the imperative competences in the administrative-legal protection and court in the administrative-judicial protection. Another model which is less accepted in the world and which in the practice did not prove itself is the one where the control is performed by independent bodies not with imperative but with the 'ombudsman' competences. Some countries have also 'atypical' approach to the protection of this right which does not include administrative instance of the control but only the court protection. Model of the protection through the independent control body with the imperative competences has shown the best results and today it is increasingly expanding. It has been accepted not only by countries in transition, but also by some developed western democracies.
AB  - Potraga za novim i efikasnijim oblicima kontrole javne uprave, odnosno organa javne vlasti uopšte, dovela je, sredinom 60-tih godina 20. veka do nastanka jednog novog prava građana, koji pojedini autori možda i sa pravom nazivaju fundamentalnim - prava na slobodan pristup informacijama (SPI). Ovo pravo se za poslednjih pedeset godina brzo proširilo na sve kontinente, te danas više od 100 zemalja sveta posebnim zakonima bliže uređuju način njegovog ostvarivanja i zaštitu. U ovom radu izvršena je komparativna analiza upravno-procesne i drugih sličnih oblika zaštite prava na pristup informacijama u 19 zemalja. Istraživanje otkriva da se uporednim zakonodavstvima mogu prepoznati više različitih modela njegove zaštite. Jedan broj zemalja istrajava na tradicionalnom modelu upravno-procesne zaštite i kada je reč o ovom pravu. Međutim, kako afirmacijom ovog prava građani postaju 'četvrta vlast' koja neposredno kontroliše rad državnih organa, vremenom su nastali i novi modeli koji se razlikuje od pomenutog tradicionalnog. To je ponajpre model u kome učestvuje nezavistan i samostalan kontrolni organ sa imperativnim ovlašćenjima u procesu upravno-pravne, i sud, u postupku upravno-sudske zaštite. Još jedan model koji je u svetu manje prihvaćen i koji se u praksi nije pokazao i dokazao je onaj u kome kontrolu vrše nezavisni organi ali sa 'ombudsmanskim' a ne imperativnim ovlašćenjima. Pojedine zemlje imaju i 'atipičan' pristup u zaštiti ovog prava, u kome nema upravne instancione kontrole, već postoji samo sudska zaštita. Model zaštite preko nezavisnog kontrolnog organa sa imperativnim ovlašćenjima pokazao je najbolje rezultate i danas se sve više širi. Njega su preuzele ne samo zemlje u tranziciji već i pojedine razvijene zapadne demokratije.

AB  - Since the earliest times, with development of state and law, a man was looking for true natural law. After the World War II, the quest for improvement of the original concept of the Rechtstaat had started and human rights ceased to be an expression of “sovereignty” of a state, acquiring a universal character. In the mid 60-ies of XX century, from the freedom of expression, as a fundamental political right, gradually set aside one special and specific right - the right of access to information (FOIA), which has expanded to all continents. It affirms the role of citizens as “fourth power”, and on the other, ensures the implementation of one of the basic principles of modern public administration - the principle of transparency. Specifics of this law have led to development of many different models of realization and its administrative-procedural protections in national legal systems. Barely in 2004, with the adoption of the FOIA Law, Republic of Serbia determined the way of realization and protection of this right. Specifics of implementation and administrative protection of the FOIA in Serbia, can significantly contribute to the “radical” reform of the general administrative procedure in the future, which is a key factor for the actual transformation of public administration in a functional sense, from the administration as an instrument of power to administration as a citizens service.

AB  - Human resource management (HRM) subsystem within the system of public administration represents one of the cornerstones of its successful reform. Over the last few
decades, worldwide dominant managerial approach to public administration (New Public
Management), which insists solely on its economical values (the so-called „three e approach“ – economics, efficiency and effectiveness) demanded significant adaptations in terms
of its managing function and structure, as well as the HRM. Transfer of private corporation
management to public administration required creation of a new human resource manage-
ment subsystem. This important link in the reform chain has yet to be implemented in the
Republic of Serbia, while the possible ways and goals remain mostly indefinite. In order to
create successful HRM system within the public administration it is however necessary to
take the specifics of managerial organization into account. Some of its specificity, from the
system theory point of view, limit the direct transfer of HRM principles from the private
sector to the public administration. This is why it is possible to claim, within organizational
sciences framework, that public administration HRM is, in fact, a subgroup of HRM which,
as a consequence of administrative organization specificity, is subsequently becoming ever
more detached from it.

AB  - Personal data protection is an integral part of the corpus of the right to privacy, as a human right. As such, it is guaranteed in the Charter of Human Rights of the EU through the right to respect for private and family life and protection of personal data. Standards of protection of personal data, as a subjective, personal right of citizens, were determined at the level of the EU Directive 95/46 EC. Progress in modern information and communication technologies caused further development and improvement of these standards through other later EU directives. The importance of this right for the EU is also demonstrated in the fact that already in 2012 the Proposal of the Regulation on the protection of individuals with regard to the processing of personal data and on the free movement of such data was prepared and it will soon replace Directive 95/46 EC. Therefore, in the near future, data protection will no longer be a question of harmonization, but the field of direct implementation of the of EU legislation. According to the European Commission reports on Serbia's progress, the Serbian Law on Personal Data Protection (2008) was in several occasions evaluated only as partially harmonized with Directive 95/46/EC and with later EU legislations. After the entry into force of the SAA, the Republic of Serbia has an obligation for harmonization. In this paper, the key shortcomings of the legislative framework within this area in the Republic of Serbia are presented and recommendations for their resolution are provided.
AB  - Republika Srbija još uvek nije harmonizovala opšti zakonski okvir zaštite podataka o ličnosti sa brojnim propisima EU u ovoj oblasti, a zakonska razrada pojedinih principa nije u duhu pomenutih propisa. To nameće potrebu za hitonom reformom zakonodavstva u ovoj oblasti, tačnije donošenje novog ZZPL koji bi sadržao opšte principe i razradu opštih principa zaštite podataka, i koji bi bio potpuno usklađen sa evropskim standardima. Na osnovu temeljno izvršene analize sadašnjeg ZPPL ali i komunitarnog prava Evropske unije, prakse sprovođenja ZZPL i drugih analiza i izveštaja, mogli bi da izvedeom pet opštih preporuka u smislu budućeg zakonskog uređenja ove oblasti što podrazumeva i donošenje potpuno novog ZZPL: (1) harmonizovati zakonodavni okvir sa direktivama Evropske unije; (2) obezbediti efektivnu primenu zakona; (3) unaprediti postupak ostvarivanja prava na zaštitu podataka; (4) posebno zakonski urediti obradu podataka u pojedinim oblastima; (5) proširiti nadležnosti nezavisnog nadzornog organa (Poverenika). Svaka od ovih opštih preporuka, podrazumeva i posebne preporuke, koje sadržinski bliže ukazuju na nedostatke postojećeg pravnog okvira i mogućnost njihovog prvazilaženja. U pogledu harmonizacija sa propisima EU, neophodno je: (1) usaglasiti definicije zakonskih pojmova sa propisima EU; (2) utvrditi i razraditi načelo zakonitosti i pravičnosti obrade i načelo zabrane diskriminacije; (3) uskladiti i razraditi odredbe o teritorijalnoj obradi; (4) utvrditi i razraditi način na koji se daje nedvosmislen pristanak za obradu podataka; (5) detaljno razraditi principe na kojima se zasniva ugovorni odnos rukovaoca i obrađivača; (6) uskladiti način obrade posebnih kategorija podataka; (7) uskladiti način obaveštavanja lica o kome se podaci prikupljaju i obrađuju; (8) uskladiti obavezu obaveštavanja nadzornog organa i utvrditi razloge za izuzetke; (9) razraditi pravo na naknadu štete; (10) utvrditi obavezu ustanovljavanja nacionalnog kodeksa; (11) utvrditi posebne obaveze u vezi sa bezbednošću podataka, i prijavu prodora u bezbednost podataka. U pogledu unapređivanje efektivnosti sprovođenja zakona, neophodno je: (1) preciznije utvrditi posebna prava koja čine sadržinu prava na zaštitu podataka o ličnosti i utvrditi kao posebno pravo - pravo na naknadu štete; (2) zakonski definisati odnos između prava na pristup informacijama i prava na zaštitu podataka o ličnosti, koja ne bi davala prevagu nijednom od njih; (3) izmeniti rešenja o Centralnom registru koja su se do sada u praksi pokazala neefetivnim; (4) utvrditi posebno lice za zaštitu podataka kod rukovaoca podacima. U pogledu unapređivanja postupka ostvarivanja i zaštite prava, potrebno je: (1) u celosti redefinisati dosadašnji postupak po zahtevu za ostvarivanje prava, uzimajući u obzir da subjekti koji vrše obradu podataka nisu samo organi javne vlasti već i subjekti privatnog prava (fizička lica i pravna lica); (2) ustanoviti novi postupak pred Poverenikom koji ne bi imao obeležja postupak upravne kontrole po žalbi, već specifičnog postupka za zaštitu prava, sa obeležjima posebnog upravnog postuka; (3) detaljno definisati postupak prenosa podataka u treće zemlje, uslove za prenos podataka i postupka izdavanja dozvole za iznošenje podataka pred Poverenikom. U pogledu zakonskog uređenja pojedinih posebnih oblasti, u budućem zakonu potrebno je: (1) definisati pojam biometrijskih podatka, i utvrditi uslove obrade ovih podataka; (2) definisati pojam video-nadzora i formulisati uslove pod kojima se video-nadzor vrši; (3) definisati pojam direktnog marketinga i obrade podataka u vezi sa direktnim marketingom; (4) utvrditi zabranu objavljivanja JMBG građana putem interenta; (5) uvesti zabranu obrade podataka kopiranjem i skeniranjem ličnih dokumenata, osim u slučajevima kada je to zakonom izričito dozvoljeno. U reformizakonodavstva u ovoj oblasti, posebna pažnja mora se posvetiti jačanju i širenju sadašnjih nadležnosti Poverenika. U tom smislu neophodno je: (1) proširiti nadležnosti Poverenika koje se odnose na postupak donošenja zakona koji se odnose na zaštitu podataka o ličnosti; (2) osnažiti ovlašćenja Poverenika koja se odnose na inspekcijski nadzor; (3) utvrditi obaveze Poverenika u vezi sa sprovođenjem, organizovanjem i polaganjem stručnog ispita za lica za zaštitu podataka o ličnosti (Data Protection Officers); (4) utvrditi nove nadležnosti Poverenika u posebnim, do sada pravno neuređenim oblastima; i (5) obezbediti mogućnost da Poverenik naredi rukovaocu podataka da utvrđene nepravilnosti u radu otkloni.

Svaka od ovih opštih preporuka, podrazumeva i posebne preporuke, koje sadržinski bliže ukazuju na nedostatke postojećeg pravnog okvira i mogućnost njihovog prvazilaženja. U pogledu unapređivanje efektivnosti sprovođenja zakona, neophodno je: (1) preciznije utvrditi posebna prava koja čine sadržinu prava na zaštitu podataka o ličnosti i utvrditi kao posebno pravo - pravo na naknadu štete; (2) zakonski definisati odnos između prava na pristup informacijama i prava na zaštitu podataka o ličnosti, koja ne bi davala prevagu nijednom od njih; (3) izmeniti rešenja o Centralnom registru koja su se do sada u praksi pokazala neefetivnim; (4) utvrditi posebno lice za zaštitu podataka kod rukovaoca podacima. U pogledu unapređivanja postupka ostvarivanja i zaštite prava, potrebno je: (1) u celosti redefinisati dosadašnji postupak po zahtevu za ostvarivanje prava, uzimajući u obzir da subjekti koji vrše obradu podataka nisu samo organi javne vlasti već i subjekti privatnog prava (fizička lica i pravna lica); (2) ustanoviti novi postupak pred Poverenikom koji ne bi imao obeležja postupak upravne kontrole po žalbi, već specifičnog postupka za zaštitu prava, sa obeležjima posebnog upravnog postuka; (3) detaljno definisati postupak prenosa podataka u treće zemlje, uslove za prenos podataka i postupka izdavanja dozvole za iznošenje podataka pred Poverenikom. U pogledu zakonskog uređenja pojedinih posebnih oblasti, u budućem zakonu potrebno je: (1) definisati pojam biometrijskih podatka, i utvrditi uslove obrade ovih podataka; (2) definisati pojam video-nadzora i formulisati uslove pod kojima se video-nadzor vrši; (3) definisati pojam direktnog marketinga i obrade podataka u vezi sa direktnim marketingom; (4) utvrditi zabranu objavljivanja JMBG građana putem interenta; (5) uvesti zabranu obrade podataka kopiranjem i skeniranjem ličnih dokumenata, osim u slučajevima kada je to zakonom izričito dozvoljeno. AB  - In the last twenty years, the development of information and communication technologies has enabled a fundamental transformation of modern public administration. Recognizing the importance of ICT, many international organizations have begun to view e-Government as a global phenomenon and a means to achieve 'good governance', to improve the quality of public service delivery, and to improve the system of public administration. In the global context of e- Government, Serbia has made significant first steps. Yet, it is obvious that the establishment of e-Government entails numerous challenges. Therefore, substantial and rapid reforms have to be undertaken in this field as well, as part of the EU accession process and strengthening of the global position of Serbia.
AB  - Razvoj informaciono-komunikacionih tehnologija omogućio je u poslednjih dvadeset godina temeljni preobražaj moderne javne uprave. Uočavajući značaj informaciono-komunikacionih tehnologija, brojne međunarodne organizacije počinju da posmatraju e-upravu kao globalni fenomen i sredstvo za postizanje 'dobre uprave unapređivanje kvaliteta pružanja javnih usluga klijetima i unapređivanje sistema javnog upravljanja. Republika Srbija je u globalnom kontekstu e-uprave napravila značajne početne korake. Ipak, očigledno je da uspostavljanje e-uprave prate brojni izazovi. Zato se u daljem procesu približavanja EU i jačanju položaja Republike Srbije u globalnom kontekstu, i u ovoj oblasti moraju preduzeti suštinske i brze reforme.

Therefore, substantial and rapid reforms have to be undertaken in this field as well, as part of the EU accession process and strengthening of the global position of Serbia., Razvoj informaciono-komunikacionih tehnologija omogućio je u poslednjih dvadeset godina temeljni preobražaj moderne javne uprave. Uočavajući značaj informaciono-komunikacionih tehnologija, brojne međunarodne organizacije počinju da posmatraju e-upravu kao globalni fenomen i sredstvo za postizanje 'dobre uprave unapređivanje kvaliteta pružanja javnih usluga klijetima i unapređivanje sistema javnog upravljanja. Republika Srbija je u globalnom kontekstu e-uprave napravila značajne početne korake. Ipak, očigledno je da uspostavljanje e-uprave prate brojni izazovi. Zato se u daljem procesu približavanja EU i jačanju položaja Republike Srbije u globalnom kontekstu, i u ovoj oblasti moraju preduzeti suštinske i brze reforme.",

AB  - The main goal of this article is to show how local ombudsmen in Serbia work. The article analysis data gained by available legal documents, as well as by empirical research conducted in November 2011. Text contains three parts: one is dedicated to the capacities of this institution, predominantly the office of local ombudsman; the second analyses the quality of ombudsman's work, as well as the quality of work of local government bodies, which this institution controls; the third one focuses on the relationship between ombudsmen on different levels of government (local, pokraina's and republic ombudsman), on the manner of ombudsman' capacity improvement and on the relationship with other local government bodies. The main instrument for measurement of the quality of ombudsman' work is usefulness of this institute to citizens, having in mind the protection of their rights and strengthening responsibility of government bodies as well as upgrading the quality of democratic culture.
AB  - Ovaj članak ima za cilj da prikaže na koji način funkcionišu lokalni ombudsmani u Srbiji. Članak analizira podatke do kojih se došlo kroz dostupne pravne izvore, kao i one do kojih se došlo empirijskim istraživanjem, sprovedenim tokom novembra 2011. godine. Tekst se sastoji iz tri celine: jedna je posvećena kapacitetima institucije, a pre svega službe (kancelarije) lokalnih ombudsmana; druga analizira kvalitet rada ombudsmana i kvalitet rada lokalnih organa vlasti koje ovaj organ kontroliše; treća se bavi odnosom između institucija ombudsmana na različitim nivoima vlasti (lokalnih, pokrajinskog i republičkog ombudsmana), načinom obogaćivanja kvaliteta rada ove institucije i odnosima sa drugim organima lokalne vlasti. Kao merni instrument kvaliteta rada ovog instituta analizira se korisnost ovog organa za građane u smislu njihove zaštite od zloupotreba i doprinosa ovog organa jačanju odgovornosti organa vlasti, kao i jačanju demokratske kulture društva.

AB  - Emergence of industrial society raises a number of important questions for researchers and organizational sciences. Existing theories of organizations (related to industrial engineering and business systems) are characterized by fragmentation and an absolute relativism. This position is a result of the continuous displacement of gravity between the organization processes and institutions and on the other hand, the interaction of man and organizations. Therefore, proper guidance can be difficult for other organizational science. The setting of this question and the search for answers has a stake in the philosophy of science. By accepting the facts in the life situations (dualism of determinism and phenomenology) is the basis of the philosophy of facticity in the science on business organization. Problems of the organization are present in all areas of human activity. This fact determines the issue of demarcation of organizational and other sciences. Determine the structure and abstraction some of organizational science, and special areas of research organizations in the social systems is a step that allows the intensification of research in the future.
AB  - Nastajanje postindustrijskog društva postavlja brojna i značajna pitanja istraživačima organizacionih nauka. Postojeće teorije organizacija (koje se odnose na organizaciju preduzeća, odnosno poslovnih sistema) karakteriše fragmentarnost i apsolutni relativizam. Ovakav pristup ima rezultat u neprekidnom izmeštanju težišta između organizacije procesa i institucija i sa druge strane, interakcije čoveka i organizacija. Zato odgovarajući putokaz teško može biti za ostale organizacione nauke. Postavka ovog pitanja i traganje za odgovorom ima oslonac u filozofiji nauka. Prihvatanjem činjenica u okviru životnih situacija (dualizma determinizma i fenomenologije) je osnov filozofije fakticiteta u Nauci o organizaciji poslovanja. Problemi organizacije prisutni su u svim područjima ljudskog delovanja. Ova činjenica određuje pitanje razgraničenja organizacionih sa drugim naukama. Određivanje strukture i apstrahovanja pojedinih organizacionih nauka, odnosno posebnih područja istraživanja organizacije u društvenim sistemima predstavlja iskorak koji omogućava intenziviranje istraživanja u narednom periodu.

AB  - Development of human society demanded a search for new mechanisms in the realization of 'administrative justice' before the public administration bodies. Internal control of public administration in appeal procedure before a higher authority and external control of public administration carried out by the courts are no longer sufficient. In time other forms of administrative control were created, such as, for example, the Ombudsman. In countries of common-law system, however, since the Middle Ages began to appear a specific form of internal control of public administration, embodied in the institution of administrative tribunals. Introduction of administrative tribunals can be of great importance in transition countries, including Serbia, which require appropriate analysis of this institution.
AB  - Razvoj ljudskog društva, zahtevao je traženje novih mehanizama u ostvarivanju 'administrativne pravde' pred organima javne uprave. Unutrašnja kontrole javne uprave u postuku po žalbi pred višim organom, i spoljna kontrole javne uprave koju vrše sudovi, više nisu dovoljni. Vremenom su nastali i drugi oblici kontrole uprave, poput na primer, one od strane ombudsmana. U zemljama commonlaw sistema međutim, još od srednjeg veka počinje da se javlja jedan specifičan oblik unutrašnje kontrole javne uprave, oličen u instituciji upravnih tribunala. Uvođenje upravnih tribunala može biti od velikog značaja u zemljama u tranziciji, između ostalog i u Srbiji, što zahteva i odgovarajuću analizu ove institucije.
