The EU's stability-democracy dilemma in the context of the problematic accession of the Western Balkan states

AB  - The accession of the remaining six Western Balkan states into the EU is shrouded in much uncertainty. Despite Croatia finally traversing the difficult path to eventual membership in 2013, not one of the remaining Western Balkan countries can claim to be on a definite pathway to membership today. An increasingly prevalent argument is that the EU's engagement with its neighbourhoods has faltered because its strategies have been undermined by an inherent stability-democracy dilemma. This article examines the EU's engagement with the Western Balkans and finds that although the EU tried to transcend this dilemma, in reality, a tension between stability and democracy was present with the former generally receiving more attention in policymaking. This led to not only a lack of tangible democratization amongst the Western Balkan states, but further uncertainty about their accession prospects. By 2018, it was clear that the EU's engagement with the Western Balkans needed a rethink, resulting in a new approach: the 'Six Flagship Initiatives'. However, given the apprehensiveness of some member states (especially France) coupled with the presence of outsiders such as Russia and China in the area, the accession prospects of the six non-EU Western Balkan states remains blurred.

The European Parliament and reform of the Common European asylum system

AB  - Migrant crisis and large number of asilym seekers created pressure to re-form the Common European asylum System (CEaS). in 2016 the European Commission proposed a reform package that should be adopted according to ordinary legislative procedure. The goal of this article is to analyse the role of EU institutions, and especially European Parliament, in the process of adop-tion of Dublin IV, the centerpeice of CEaS reform package. The main thesis is that European Parliament, although supportive of CEaS reform, remains a secondary actor compared to EU member states which are unable to achieve an agreement on the most important elements of the reform. Recent elec-tions for the European Parliament raise the issue whether the Parliament's stance would be changed, but another question is even more important -what would be, having in mind member states positions, the fate of the pro-posed reform package.
AB  - Migrantska kriza koja je zahvatila Evropsku uniju (EU) poslednjih godina, sa velikim brojem tražilaca azila u zemljama članicama, nametnula je neophodnost promene zajedničkog evropskog sistema azila. Reforma predložena 2016. godine obuhvata paket legislativnih predloga koji treba da budu usvojeni po redovnoj zakonodavnoj proceduri. Cilj ovog rada je da analizira ulogu institucija EU, a posebno Evropskog parlamenta, u dosadašnjem toku usvajanja Dablina IV kao ključnog dela predloženog reformskog paketa, kao i da pokuša da predvidi njegov stav u daljem procesu. Osnovna teza rada je da Evropski parlament, iako jedan od promotera promene zajedničkog evropskog sistema azila, ostaje sekundaran akter u odnosu na zemlje članice koje u Savetu EU ne uspevaju da postignu dogovor o najvažnijim elementima reforme. Visoko politizovano pitanje azila i migracija je u prethodnom sazivu Evropskog parlamenta u najvećoj meri narušilo koheziju EPP-a, ali i pokazalo da su poslanici iz zemalja koje imaju najviše primedbi na predložene reforme glasali češće u skladu sa nacionalnim prioritetima nego sa politikom partijske grupe. Nedavno održani izbori za Evropski parlament otvaraju dilemu da li će stav Parlamenta biti promenjen, ali se postavlja i drugo pitanje - kakva će, uzimajući u obzir stavove zemalja članica, biti sudbina predloženih reformi.

Parlamentarization of the European commission president appointment: a step towards a more democratic European Union?

AB  - The 2014 European Parliament elections brought a campaign novelty: for the first time European parties put forward so-called 'Spitzenkandidaten', i.e. lead candidates for the position of President of the European Commission. The thesis of this article is that parlamentarization of the European Commission president appointment is not a step towards a more democratic European Union, for two reasons. First, the European Commission, in spite of being EU's executive body, is not the executive of the European Parliament as single legislator, but rather part of a complex institutional quadrangle comprised of the European Council, the European Parliament, the Council and the European Commission. Second, the European Parliament, elected in 'second order' elections, and the role of national and European parties in the EU electoral and governance system do not provide for political representation that could serve as basis for a responsible party government model. Responsibility of both national and European political parties for policy making in the EU needs to be strengthened.

European neighbourhood policy: Failed expectations?

AB  - European Neighourhood Policy (ENP), launched 2004 as an instrument of closer relations with neighbours at east and south of Europe, was from the very beginning overambitious and contradictory policy. ENP not only overemphasized the EU normative power, but EU influence could not prevent political and security set-backs in the east, nor destabilization in the south. EU influence on reforms, democratization processes, foreign policies or conflict resolution in Eastern partnership countries is limited, while eastern regimes are more and more authoritarian and countries stucked in partial market reforms. In the south, Euro-Mediterranean Partnership and Union for Mediterranean are facing new challenges after Arab spring. EU announced more strict use of conditionality as an incentive for political reforms, but power of EU conditionality towards countries which have not prospect or desire to become EU members is questionable.
AB  - Evropska politika susedstva, pokrenuta 2004. godine kao instrument ostvarivanja bližih odnosa sa zemljama susedima na istoku i jugu EU, od početka je predstavljala preambicioznu i protivrečnu politiku koja ne samo da je precenila snagu svog normativnog uticaja, već svojim uticajem nije uspela da spreči pogoršanje bezbednosne i političke situacije na istoku Evrope, kao ni porast nestabilnosti u Mediteranu. Uticaj EU na reforme, proces demokratizacije, spoljne politike ili rešavanje sukoba u zemljama Istočnog partnerstva ograničen je a režimi na istoku sve autoritarniji i tržišne reforme se polovično sprovode. Na jugu, evro-mediteransko partnerstvo i Unija za Mediteran suočavaju se sa novim izazovima nakon arapskog proleća. EU najavljuje striktniju primenu uslovljavanja u cilju podsticanja političkih reformi, ali snaga uslovljavanja prema zemljama koje ne mogu ili ne žele da postanu članice EU ostaje pod znakom pitanja.

European Commission's declining power of influence

AB  - One of the European Commission's most important function is exercise of power of influence in the process of adoption of the European Union's legislative acts and policies. Article is focused on Liberal intergovernmental and New Institutionalism's views on formal and informal supranational power of initiative, as well as evolution of European Commission's power of initiative from Treaty of Rome to Treaty of Lisbon. This evolution confirms that European Commission's power of initiative was gradually declining through decision making procedure reforms, as well as by strengthening of other EU institutions.
AB  - Jedna od najznačajnijih funkcija Evropske komisije je vršenje prava inicijative za usvajanje zakonodavnih akata i politika Evropske unije (EU). U radu se daje pregled stavova liberalnog međuvladinog pristupa i novog institucionalizma o formalnoj i neformalnoj moći nadnacionalne inicijative, kao i evolucije moći inicijative Evropske komisije u procesu odlučivanja od Rimskog ugovora do Ugovora iz Lisabona. Praćenje ove evolucije potvrđuje da je moć inicijative Evropske komisije postepeno smanjivana kako reformom procedura odlučivanja, tako i jačanjem drugih institucija EU.

COREPER, the EU Council's best known coordinating body, is the iceberg of the whole network of committees and working groups and is important for the understanding of the so-called EU 'commitology' phenomena. European integration process led to the proliferation of different kind of working groups. Characteristic of Council's working groups is development of specific functioning focused to compromise as the basis for decision making, which is confirmed by empirical research. On the other hand, these bodies, as the Council itself, reflect the standing contradiction between supranational and national aspects of EU decision making.
AB  - Cilj ovog rada je da razmotri složenost funkcionisanja Saveta Evropske unije (EU) iz ugla delovanja njegovih radnih tela. COREPER, najpoznatije koordinaciono telo Saveta EU, predstavlja vrh ledenog brega čitave mreže komiteta i radnih grupa, i u tom smislu je značajan za razumevanje fenomena tzv. 'komitologije' u EU. Proces evropske integracije je doveo do proliferacije radnih tela različitih vrsta, a za radna tela Saveta je karakteristično da je u njima razvijen poseban način funkcionisanja usmeren na traženje kompromisa kao osnove donošenja odluka, što potvrđuju i empirijska istraživanja. Sa druge strane, ova tela, kao i sam Savet EU, odražavaju trajnu protivrečnost između nadnacionalnog i međuvladinog aspekta u procesu donošenja odluka u EU.

AB  - The goal of this article is to provide an overview of organized interest intermediation in the EU: interest representation actors, their access to the legislative process and relation with key institutions - European Commission, Council and European Parliament. Several models of interest representation exists in the EU - corporative, pluralist and neopluralist. EU political process has led to proliferation of lobbying at the European level, while at the same time interest groups continued their national activities.
AB  - Cilj rada je da predoči pregled razvoja delovanja organizovanog interesa u Evropskoj uniji (EU), i to kako u pogledu aktera koji ovaj interes zastupaju, tako i njihovog pristupa zakonodavnom procesu i odnosa sa ključnim institucijama - Evropskom komisijom, Savetom i Evropskim parlamentom. Politički proces u EU, u kojem je zastupljeno više modela interesnog predstavljanja - korporativni, pluralistički i neopluralistički, doveo je do proliferacije lobiranja na nivou EU, ali se paralelno sa tim nastavlja delovanje interesnih grupa na nacionalnom/nacionalnim nivoima.

AB  - This article is focused on different aspects of the functioning of the Council of the European Union (EU). The Council's multi-dimensionality is a consequence of its different formal and informal roles. With more and more competences at the EU level, the Council became a highly fragmented structure. At the same time, this institution acts as a club of member States executive powers, as compromise reaching forum, as an arena for power battle between Member States, and as the key institution for new modes of governance in the EU. Much more empirical research will be needed in order to achieve full understanding of the Council's actual functioning.
AB  - Članak razmatra različite aspekte funkcionisanja Saveta Evropske unije (EU). Višedimenzionalnost Saveta je posledica njegovih različitih formalnih i neformalnih uloga. Sa sve većim brojem nadležnosti na nivou EU, Savet je postao visoko fragmentirana struktura. Ova institucija istovremeno deluje kao klub izvršnih vlasti zemalja članica, kao forum za postizanje kompromisa, kao arena borbe za moć između zemalja članica, i kao ključna institucija novih vidova upravljanja u EU. Za potpuno razumevanje načina na koji Savet u praksi funkcioniše biće potrebno mnogo više empirijskih istraživanja.
