AB  - Predmet analize su reforme u oblasti rada i radnih odnosa u Srbiji iz ugla socijalne politike. Cilj autorki je da analizom njihovih efekata, posredstvom opisa stanja na tržištu rada, ukažu na prilike, ali i na prepreke za realizovanje agende zapošljavanja. Teorijski okvir analize predstavljaju postavke Gaja Stendinga (Guy Standing) o prekarijatu, pod kojim se podrazumeva klasa ljudi koja se ubrzano uvećava, a kojoj pripadaju svi oni čiji su životi obojeni različitim vrstama nesigurnosti, koje su u vezi sa radom. Metodološki pristup zasniva se na prezentovanju regulatornih instrumenata i statističkih podataka. Rezultati analize ukazuju na opstajanje niza nepovoljnih trendova u oblasti rada, prvenstveno kao posledica dva trenda: uvođenja određenih neadekvatnih regulatornih odredbi, uporedo sa odsustvom mehanizama implementacije regulatornih odredbi koje bi potencijalno imale pozitivne efekte.

Inclusive role of civil society in the provision of services for disabled persons in the Republic of Serbia

AB  - The reform of the social welfare system since the beginning of year 2000 was directed towards expanding the actors of system, along with the development of quality, efficiency and effectiveness of the rights and services that are provided to the users. The engagement of civil society in providing services to persons with disabilities has been continuously upgraded towards increasing the effectiveness of services to empower users. The main objectives of this paper are the mapping of social services provided by civil sector, detection of obstacles in the development and implementation of social services of civil sector at local level, as well as assessment of users satisfaction with the provided services. Through analysis of documents, participation of the civil sector will be evaluated along with the mapping of the advantages and difficulties in the implementation of social services provided by the civil sector. Addition to this research is empirical research in the city of Kraljevo. Through a questionnaire addressed to the service providers and service users the content has been examined as well as the quality and possibilities of improving social services at the local level. The results show that certain types of social services are more frequent, daily services and services for independent living, while in the city of Kraljevo project activities are often implemented and the main problem is the lack of continuous funding. Service users are mostly satisfied with the engagement of providers and with improving personal awareness of additional activities in which they can participate and the rights that they can exercise. Research findings are that the civil sector promotes social inclusion of persons with disabilities, but it is necessary to engage public sector in the development and implementation of social services at the local level.
AB  - Reforma sistema socijalne zaštite od početka 2000. godine bila je usmerena prema proširivanju aktera u sistemu, uz razvoj kvaliteta, efikasnosti i efektivnosti prava i usluga koje se pružaju korisnicima sistema socijalne zaštite. Angažovanje civilnog sektora u pružanju usluga osobama sa invaliditetom, kontinuirano je unapređivano u pravcu povećanja efektivnosti usluga za osnaživanje korisnika. U skladu sa tim, osnovni ciljevi ovog rada su mapiranje usluga socijalne zaštite koje pruža civilni sektor, detekcija prepreka u razvoju i sprovođenju socijalnih usluga civilnog sektora na lokalnom nivou, kao i procena zadovoljstva korisnika pruženim uslugama. Analizom sadržaja dokumenata biće predstavljene aktivnosti i evaluirano učešće civilnog sektora, uz mapiranje prednosti i teškoća u sprovođenju socijalnih usluga. Dodatak istraživanju predstavlja empirijsko istraživanje u Gradu Kraljevu, u kome su se putem upitnika koji su upućeni pružaocima usluga na lokalnom nivou i korisnicima usluga ispitivali sadržaj, kvalitet i mogućnosti unapređenja socijalnih usluga. Rezultati teorijskog i empirijskog istraživanja pokazuju da su određene vrste socijalnih usluga zastupljenije, dnevne usluge i usluge za samostalan život, dok se u Gradu Kraljevu češće sprovode projektne aktivnosti i kao glavni problem se javlja odsustvo kontinuiranog finansiranja. Korisnici usluga u najvećoj meri su zadovoljni angažovanjem pružalaca usluga i unapređenjem informisanosti o dodatnim aktivnostima u kojima mogu učestvovati i pravima koja mogu ostvariti. Zaključci istraživanja su da civilni sektor unapređuje socijalno uključivanje osoba sa invaliditetom, ali i da je neophodno dodatno angažovanje državnog sektora u razvoju i sprovođenju socijalnih usluga na lokalnom nivou.

Anti-oppressive practice in achieving the right to financial social assistance: Obstacles and possibilities

AB  - Shifting the focus from an individual to the structural causes of poverty creation and maintenance is present in the recent decades. In this process, a key role is played by social services which are in direct contact with clients and which have the task to improve their position in society. The main claim of this paper is that the current national system of social assistance in Serbia creates and maintains the oppressive practice in work with poor clients. The objectives of this article are: analysis of the mechanism to exercise the right to cash benefits, from the submission to approval of the request; systematization and analysis of the institutional and systemic obstacles to exercising the right to financial social assistance; detection of oppressive practice elements in the welfare centers and in their work with the poor. Findings indicate that there are multiple obstacles on relations system-client and social worker-client that prevent the use of anti-oppressive practice in practice.
AB  - Pomeranje fokusa sa individualnih na strukturne uzroke kreiranja i održavanja siromaštva aktuelno je poslednjih decenija. U ovom procesu ključnu ulogu imaju socijalne službe koje u neposrednom kontaktu sa korisnicima socijalne zaštite imaju zadatak da unaprede njihov položaj u društvu. Osnovna tvrdnja ovog rada je da aktuelni nacionalni sistem novčane socijalne pomoći u Srbiji kreira i održava opresivnu praksu u radu sa siromašnim korisnicima. U radu će biti analiziran mehanizam ostvarivanja prava na novčanu socijalnu pomoć od podnošenja do odobravanja zahteva; sistematizovane i analizirane institucionalne i sistemske prepreke za ostvarivanje prava na novčanu socijalnu pomoć; detektovani elementi opresivne prakse u centrima za socijalni rad u radu sa siromašnima. Nalazi upućuju na to da postoje višestruke prepreke na relacijama sistem - korisnik i stručni radnik - korisnik koje onemogućavaju primenu antipotčinjavajuće prakse u praksi.

Access of disabled persons to higher education at University of Belgrade

AB  - Right to higher education in Republic of Serbia implies to all persons who have acquired secondary education, which is regulated by the Law on Higher Education. Despite this, conducted research confirms a small proportion of students with disabilities in the total student population. The aims of this paper are to analyze normative acts concerning the protection of the right to higher education for persons with disabilities, as well as spotting the obstacles that people with disabilities face in accessing higher education at the University of Belgrade. In the first part of the paper will be presented national legal frame- work for people with disabilities in higher education, while the other part relates to the obstacles in access to education through the analysis of the content of legal acts of the faculties. Contribution to the analysis is questionnaire sent to faculties that examines the existence and content of support for students with disabilities in practice. Conducted research indicates multiple obstacles these students face in all segments of the educational process.
AB  - Ostvarivanje prava na visoko obrazovanje u Republici Srbiji podrazumeva pravo koje imaju sva lica koja su stekla srednjoškolsko obrazovanje, što je regulisano Zakonom o visokom obrazovanju. Uprkos ovakvom stavu, sprovedena istraživanja potvrđuju mali udeo studenata sa invaliditetom u ukupnoj studentskoj populaciji. Ciljevi rada su analiza normativnih akata koji se tiču zaštite prava na visoko obrazovanje osoba sa invaliditetom, kao i uočavanje prepreka sa kojima se osobe sa invaliditetom sreću u pristupu visokom obrazovanju na Beogradskom univerzitetu. U prvom delu rada biće prikazan nacionalni pravni dizajn podrške osobama sa invaliditetom u oblasti visokog obrazovanja, dok se drugi deo odnosi na prepreke u pristupu obrazovanju kroz analizu sadržaja opštih akata fakulteta. Prilog analizi je i upitnik upućen fakultetima, koji ispituje postojanje i sadržaj podrške studentima sa invaliditetom u praksi. Sprovedeno istraživanje ukazuje na višestruke prepreke sa kojima se ovi studenti susreću u svim segmentima obrazovnog procesa.

Despite this, conducted research confirms a small proportion of students with disabilities in the total student population. The aims of this paper are to analyze normative acts concerning the protection of the right to higher education for persons with disabilities, as well as spotting the obstacles that people with disabilities face in accessing higher education at the University of Belgrade. Contribution to the analysis is questionnaire sent to faculties that examines the existence and content of support for students with disabilities in practice. Conducted research indicates multiple obstacles these students face in all segments of the educational process., Ostvarivanje prava na visoko obrazovanje u Republici Srbiji podrazumeva pravo koje imaju sva lica koja su stekla srednjoškolsko obrazovanje, što je regulisano Zakonom o visokom obrazovanju. Uprkos ovakvom stavu, sprovedena istraživanja potvrđuju mali udeo studenata sa invaliditetom u ukupnoj studentskoj populaciji. Ciljevi rada su analiza normativnih akata koji se tiču zaštite prava na visoko obrazovanje osoba sa invaliditetom, kao i uočavanje prepreka sa kojima se osobe sa invaliditetom sreću u pristupu visokom obrazovanju na Beogradskom univerzitetu. Minimum income support in Serbia: The adequacy of social assistance

AB  - In this article shall be conducted comparative review of minimum income support programs in the European Union as well as the institutional design of this social protection field in the Republic of Serbia. While some Member States haven't developed national minimum income schemes (Greece and Italy), current legislative regulation in our state recognizes the right to material support to poor population. The basic program of material support is achieved through social assistance payments, while the conditions and amount of financial assistance for beneficiaries are regulated by the Social Protection Law. The aim of this paper is to review adequacy of cash benefits levels of payments in relation to achieve adequate standard of living. Findings suggest that the amount of financial assistance is inadequate to uplift above the absolute poverty line. It is recommended to increase funding for programs of financial assistance or to support the reform of the minimum income which will include development of high-quality services in the community for this category of population.
AB  - U ovom članku izvršiće se komparativni prikaz programa podrške minimalnom dohotku u Evropskoj uniji i institucionalnog dizajna ovog dela sistema socijalne zaštite u Republici Srbiji. Dok pojedine države članice nemaju nacionalno razvijene šeme minimalnih prihoda (Grčka i Italija), aktuelno zakonodavno uređenje u našoj državi prepoznaje pravo na materijalnu podršku siromašnoj populaciji. Osnovni program materijalne podrške ostvaruje se kroz novčanu socijalnu pomoć, pri čemu su uslovi i visina naknade za korisnike propisani Zakonom o socijalnoj zaštiti. Cilj ovog rada je preispitivanje adekvatnosti nivoa isplata novčane socijalne pomoći u odnosu na postizanje odgovarajućeg životnog standarda. Nalazi upućuju na zaključak da je visina novčane pomoći neadekvatna za izdizanje iznad apsolutnog praga siromaštva. Preporučuje se povećanje izdvajanja za programe novčane pomoći ili reforma podrške minimalnom prihodu, koja će podrazumevati razvijanje kvalitetnih usluga u zajednici namenjenih ovoj kategoriji stanovništva.

Communitarian employment policy of the European Union: Implementation of the Open Method of Coordination

AB  - The harmonization process of minimum working conditions in the Member States can be traced back to the founding of the European Union, while common European employment policy appears after the Treaty of Amsterdam. Foundation of common Economic and Monetary Union, improvement of fiscal discipline and competitiveness were reasons why primary orientation was given to labor market policy, as the first policy institutionally included in the joint coordination mechanisms within the European Union. The main hypothesis of this paper is that usage of the Open Method of Coordination, as a method of soft law, reduce the divergence of policy outcomes in the Member States with a continuous tendency of employment growth. The aims of this paper are to show strategic direction of the EU policy as part of the employment agenda formulation, monitoring of the Methods' implementation in the previous period and to draw conclusions about policies undertaken. The analysis shows performance improvement of the Member States, considering the influence of national social security system specificities on the process effectiveness.
AB  - Proces usaglašavanja minimalnih uslova rada u državama članicama može se pratiti od osnivanja Evropske unije, dok zajednička evropska politika zapošljavanja nastupa tek s Amsterdamskim ugovorom. Uspostavljanje zajedničke Ekonomske i monetarne unije, povećanje fiskalne discipline i konkurentnosti bili su razlozi koji su primat dali politici tržišta rada, kao prvoj od politika koja je institucionalno uvrštena u zajedničke instrumente koordinacije u Evropskoj uniji. Osnovna hipoteza rada jeste da se primenom Otvorenog metoda koordinacije, kao metoda mekog prava, smanjuje divergencija ishoda politika u državama članicama sa stalnom tendencijom rasta zaposlenosti. Ciljevi rada su prikaz strateških pravaca politike EU kao deo formulisanja agende zapošljavanja, praćenje procesa implementacije u proteklom periodu primene Metoda i donošenje zaključaka o preduzetim politikama. Analiza pokazuje unapređenje performansi država članica, uz uticaj specifičnosti nacionalnih sistema socijalne sigurnosti na efektivnost procesa.
